Human rights in Kazakhstan
Human
rights, their genesis, social roots, the appointment is
one of the endless problems of not only the legal
and political but also religious, ethical, and cultural position
of the state. Historical process of human creativity depends on
the extent of the rights and freedoms, determination
its social opportunities and benefits that determines
the nature of life, a system of relations, and an interaction
of relations between people in society. Therefore, the
problem of human rights has always been a subject of
intense class battles that were fought for the possession
of rights and empowerment of people. History shows that each
generation must protect the rights that mankind has not
yet familiar with the situation in which effort isn’t
required to maintain and protect the rights and freedoms.
Thus,
human rights, as the specific requirements necessary
minimum conditions for normal life have arisen in
the primitive structure. These rights were
defined generated by custom, ritual practice, aims to
ensure interaction between members of the primitive society.
At the
present time in the modern world, there are international
legal instruments, documents establishing the universally
recognized human rights standards that define the bar, below
which the state cannot be omitted. The rights and
freedoms are no longer only the internal affairs of States,
now is the whole international community.
Kazakhstan had the honor to be
elected chairman of the OSCE, and this honorable mission
of our government to comply with a vengeance. At the same
time is not resting on our laurels, but rather building
up momentum.
It should be understood that the
lion's share of human rights abuses in Kazakhstan accounted
for the law enforcement system, but the reason is not in the
"dictatorial regime» and a huge level of corruption
in this particular sector of government. Corruption - the
derivative again, not some mythical tyranny, and
the generation of a low level of culture in society: legal
and civil. Europe to contemporary notions
of humanism was a century - through slavery, revolution,
riots, and executions of members of the
ruling dynasties. And yet the final form of human rights
in view of the Western democracies have acquired only
after World War II.
In fact, today the most important step
towards finalizing Kazakhstan as a democratic state are not
so appropriate action in the field of human
rights just as the fight against corruption, the struggle
for the rule of law, which has, direct relation to individual liberties. That corruption is
now erected in our perception of a step above the
law, is a real hindrance to strict compliance with the
rules governing human rights. National Action Plan for Human Rights in
the Republic of Kazakhstan for 2009-2012, which was created with the
active participation of international and national experts,
representatives of non-governmental sector - was a
huge furor. It took into account the generally
accepted democratic principles and standards in this area. To
eliminate the flaws in cooperation with NGOs, the Commission
on Human Rights and the Ombudsman conduct
regular meetings, "round tables", seminars, and
training sessions, make raids in the penitentiary system.
Complaints about violations of the
rights that come from human rights NGOs in Kazakhstan,
according to an agreement passed in the presidential
commission, which, by the way words are included and
most well-known authoritative representatives of civil
society, regional NGOs with experience in the field
of human rights. In the sphere of cooperation with
international organizations and national human rights
institutions of foreign countries there is a
positive growth. For example, with the assistance of the UN
Development Programme and the UNESCO Cluster Office in
Almaty has been successfully launched a digital library of
the Commission on Human Rights under President of the Kazakh and
Russian languages. CB provides free legal information
to the public in the protection of human rights.
Also among the international
human rights organizations, which work closely with Kazakhstan, there
are United Nations High Commissioner for Refugees, the International
Organization for Migration, the European Commission, the UN
Children's Fund "UNICEF". Thus, characterizing
the overall activities of national human rights protection
system, we can say that as a result of the
reforms policy of respect, promote and protect human rights and
freedoms in Kazakhstan found, so to speak, is irreversible.
In the study of human rights,
they inevitably intersect of many disciplines, as well as all industry and
procedural jurisprudence. Thus, based on international
humanitarian law, it may be noted that:
· Human rights - the highest
value, and their respect for and observance - the duty
of the state.
· Ensuring the rights
and liberties is incompatible with discrimination on
any basis.
· Personal, economic, political,
social and cultural rights are the same; in a single
system of rights is no hierarchy.
· Human rights may be restricted
by law only if there is a direct threat
to state security and public safety, health or morals,
law and the laws of others.
